Hi every1,

I am on H1. I got married earlier this year :), my wife is on OPT which expires early next year. She is currently working for XYZ company which would not extend her OPT. We haven't been able to find a job(H1) for her yet.

Would any of below can cause any problem.
1. I don't have H1 stamping from my home country??
2. Her last name is not changed??

Hi,
Find below my current visa status

1. H1B 6 years completing in Jul 2009. My firm will apply for extension in March time frame

2. I have applied for I-485 and have EAD + AP.

I am planning to travel to India for a week on AP sometime in May. I have the following Qs on this

1. Can I travel to India with AP when H1B extn is pending.

2. Will I face any issue while entering the US if my H1B is denied (or) there is an RFE on my appln?

Please answer these for me.

Hello everyone,

I have heard that if you cancel your first LC and apply for a Second one you can still use the advertisements and all from the first one if you fall withing that "6 month" period. My question is -

Is it 6 month from the first day that the advertisement was published or is it 6 month from the day your first LC was approved? :confused:
Experts please shed some light on this.

I am on an H1B visa. I have passed PERM and my priority date is Sep 2005. Then I applied to 140 and in the middle of 140 (it was last year in Aug), I changed my company. My new employer hired me for the same position and renewed my H1B for the same position. After a few months 140 was approved but it is from my old company.

Now, can I still apply to 485 even though I don't work for my previous company? In what circumstances, could this be worked out? what do I need to do?

HAS ANYBODY EXPERIENCED THIS BEFORE?

Dear forum members,

I have a question regarding transferring my H1b. My scenario is i am on my 7th year of my H1b and it is expiring on Oct 2007. My current employer will be filing an extension of 3 years based on my approved I-140 in the month of June 2007. If everything goes well i will get my three year extension(2007-2010) by Aug 2007.

Question is

1) If i get a new job opportunity after 3 year approval ( start date will be Oct 2007) can i transfer it to my new employer by aug or i have to wait till the start date of H1 approval?

2) When can i start working for the new company?

Any response will be appreciated.

Hi guys, cannot find this topic in previous threads. Appreciate it if someone can advise!

My situation is: I'm still waiting to file for I-485 with approved PERM and I-140. I'll get married right after I submit my I-485 when visa number is available and petition for her I-485. Can my future wife in China take consular processing in US consulate in China while I'm just waiting for approval in US? Normally, does she get it earlier than me since she'd ask for consular processing?

I have applied for AP (I131) on 8/14/09 and my I-485 got approved on 9/01/09. Is USCIS is going to return my I131 fee or is there anything I have to initiate from my end to get the refund?.

My company filed for H1B Extension as it is expiring in november 2009. How much time will it take to get the H1B extension approved ? Once i get H1B extension(probably for 1 year or 3 years), then should i go for H1B stamping, if so, i have to go to India for H1B Stamping. Let me know...
